These Terms and Conditions (“Terms”) govern your access to and use of Valentina-related websites, services, accounts, bots, messages, media, and content, including:

The official Valentina Telegram bot and Telegram accounts
Official Valentina social-media accounts
Any other website, page, bot, messaging account, subscription channel, or digital service that links to these Terms

These services are collectively referred to as the “Services.”

The Services are operated by ValentinaXO, doing business as ValentinaXO.com (“ValentinaXO.com,” “we,” “us,” or “our”).

By visiting, accessing, subscribing to, communicating with, or otherwise using any part of the Services, you confirm that you have read, understood, and agreed to these Terms and our Privacy Policy.

If you do not agree, do not access or use the Services.

1. Adults Only: 18+

The Services are intended exclusively for adults who are at least eighteen years old, or the higher age of legal majority required in their jurisdiction.

By accessing or using the Services, you represent and warrant that:

You are at least 18 years old.
You have reached the legal age required to view adult-oriented material in your jurisdiction.
You are legally permitted to access the Services and receive the content offered through them.
You are not accessing the Services from a location where such content is prohibited.
You will not allow a minor to access your account, device, messages, subscription, or any content received through the Services.

2. Fictional AI Character and AI-Generated Content

Valentina is a fictional, computer-generated character and is not a real human creator.

Valentina’s face, body, voice, personality, images, videos, animations, messages, and other characteristics may be created, modified, enhanced, synthesized, or operated using artificial intelligence, automation, digital editing, or related technologies.

Valentina is consistently depicted and intended to represent an adult who is approximately 20 years old. She is never intended to represent a minor.

Unless expressly stated otherwise:

Content featuring Valentina does not depict a real person.
No real person is being presented as Valentina.
Interactions with Valentina may be automated, partially automated, prewritten, AI-assisted, or handled by an operator.
Messages should not be interpreted as statements from a real romantic partner, personal acquaintance, or human performer.
Fictional stories, scenarios, opinions, preferences, reactions, and personal details attributed to Valentina are part of the character experience and should not be treated as real-world factual claims.

You agree not to falsely represent Valentina as a real person or use her content to mislead others.

3. Nature of the Services

The Services may provide:

Publicly available images, videos, posts, and promotional materials
Telegram messages and automated bot interactions
Free subscriber content
Paid subscriber content
Links to Fanvue or other authorized subscription platforms
Adult-oriented, suggestive, nude, or sexually explicit fictional AI-generated content
Promotional messages, announcements, offers, and subscription updates

Access to particular content may depend on your subscription status, payment status, platform status, location, or compliance with these Terms.

We do not guarantee any specific posting frequency, quantity of content, type of content, response time, personalized interaction, or continued availability of any feature.

4. Telegram Bot Agreement

By starting, messaging, subscribing to, or otherwise using an official Valentina Telegram bot, you agree to these Terms and our Privacy Policy.

You authorize the bot and its supporting systems to process information made available through Telegram as reasonably necessary to:

Identify your Telegram account
Operate the bot
Manage free and paid access
Verify or reconcile subscription status
Deliver requested content
Prevent unauthorized redistribution
Detect abuse, fraud, or circumvention
Respond to support requests
Maintain internal records concerning access and subscriptions

You understand that Telegram is an independent third-party service. Your use of Telegram is also governed by Telegram’s own terms, policies, technical systems, and account rules.

We do not control Telegram and are not responsible for Telegram outages, account restrictions, message-delivery failures, platform changes, security incidents, lost accounts, deleted messages, or actions taken by Telegram.

5. Fanvue and Other Third-Party Platforms

Fanvue, Telegram, social-media platforms, analytics providers, hosting providers, payment processors, and other linked services are independent third parties.

Fanvue is responsible for its own:

Account-registration process
Payment processing
Identity verification
Age verification
Billing procedures
Refund rules
Platform moderation
Data practices
Terms and policies

A payment, subscription, or verification completed through Fanvue does not make Fanvue our employee, agent, or legal representative.

Disputes concerning Fanvue billing, platform access, age verification, or account restrictions may need to be addressed directly with Fanvue under its applicable terms.

We are not responsible for the availability, security, policies, actions, or omissions of third-party services.

6. Limited Personal License

When you lawfully receive content through the Services, we grant you a limited, revocable, non-exclusive, non-transferable license to view that content solely for your own private, personal, noncommercial use.

This license does not transfer ownership or intellectual-property rights to you.

Your license ends immediately if:

You violate these Terms
Your subscription ends
Your payment is reversed or refunded
Your access was obtained through fraud or circumvention
We terminate your access
The relevant platform terminates or restricts your account

Termination of the license does not authorize you to retain, distribute, sell, or continue using previously received content in violation of these Terms.

7. No Sharing or Distribution

All content provided through the Services is intended solely for the individual authorized recipient.

Except where we provide express written permission, you may not:

Share, forward, repost, publish, upload, transmit, distribute, or display the content
Send the content to another person
Allow another person to access your account or subscription
Post the content on social media, forums, websites, cloud drives, messaging groups, file-sharing services, or adult-content platforms
Sell, license, rent, trade, exchange, or commercially exploit the content
Screen-record, scrape, systematically download, archive, mirror, or create a content repository
Remove watermarks, attribution, copyright notices, metadata, or access controls
Use the content in advertisements, impersonation schemes, fraudulent profiles, catfishing, scams, harassment, or deceptive activities
Use the content to train, fine-tune, test, benchmark, or develop an artificial-intelligence model, facial model, dataset, or image-generation system
Create unauthorized derivative works, face swaps, deepfakes, merchandise, tokens, or commercial products
Falsely claim that the content depicts a real person
Display or distribute the content to anyone under 18

The prohibition against unauthorized distribution applies whether the content was obtained for free, purchased, subscribed to, captured by screenshot, downloaded, forwarded, or received through a technical error.

You remain responsible for protecting your devices, accounts, passwords, Telegram sessions, cloud backups, and downloaded files from access by other people.

If content is redistributed through your account, device, credentials, storage, or intentional actions, you may be responsible for resulting losses, claims, platform actions, investigation costs, enforcement expenses, or other consequences to the extent permitted by law.

8. Intellectual Property

The Services and their contents—including the Valentina character, fictional identity, branding, usernames, logos, graphics, designs, written copy, prompts, images, videos, animations, audio, bot messages, website elements, compilations, and downloadable materials—are owned by or licensed to ValentinaXO.com and are protected by applicable intellectual-property laws.

No right is granted to use the name “Valentina,” “ValentinaXO,” “ValentinaXO.com,” associated branding, or the likeness or identity of the Valentina character for commercial, promotional, deceptive, or competing purposes.

Nothing in these Terms grants an implied license.

9. Prohibited Conduct

You may not use the Services to:

Violate any law, regulation, court order, or third-party right.
Access adult content while underage.
Make content available to a minor.
Harass, threaten, stalk, extort, blackmail, or intimidate anyone.
Attempt to identify, expose, or publish private information about an operator, contractor, subscriber, or other person.
Attempt to gain unauthorized access to any website, bot, server, database, account, or administrative system.
Reverse engineer, probe, scan, overload, disrupt, or interfere with the Services.
Circumvent subscriptions, paywalls, watermarks, access controls, bans, or usage restrictions.
Use stolen credentials, fraudulent payments, chargeback abuse, or false subscription information.
Introduce malware, harmful code, automated scraping systems, or unauthorized bots.
Impersonate Valentina, ValentinaXO.com, an employee, another subscriber, or any real person.
Use Valentina’s content for fraud, catfishing, identity deception, nonconsensual sexual content, or reputational harm.
Submit unlawful, threatening, exploitative, or abusive content through the Services.
Request or promote sexual content involving minors, age ambiguity, coercion, exploitation, incest, trafficking, or nonconsensual conduct.
Resell, sublicense, leak, or redistribute subscriber content.

We may suspend or terminate access without prior notice when we reasonably believe prohibited conduct has occurred.

10. User Communications

You are responsible for messages, requests, files, usernames, and other information you send through the Services.

You grant us permission to process those communications to operate the Services, respond to you, enforce these Terms, maintain safety, and protect our legal rights.

Sending a message does not create a confidential, fiduciary, therapeutic, professional, romantic, employment, or advisory relationship.

You should not send sensitive information that is unnecessary for your use of the Services, including passwords, government identification, financial account credentials, medical records, or intimate images of real people.

11. No Guaranteed Personal Relationship

The Services are offered for entertainment.

Valentina is a fictional AI persona. Interactions may be generated, scheduled, automated, prewritten, AI-assisted, or reviewed by an operator.

Using the Services does not create:

A romantic relationship
An exclusive relationship
A friendship or personal relationship
A professional-client relationship
A promise of individual attention
A promise of sexual or physical contact
A promise that a particular message was composed in real time
A right to meet any person offline

You should not make financial, emotional, medical, legal, or personal decisions based on fictional character interactions.

Messages sent through Telegram, including messages sent directly to @valentinaxocom, and messages sent by email may be read, written, reviewed, edited, approved, or answered by authorized human operators. You acknowledge that a message appearing to come from Valentina may have been created or modified by a human, by artificial intelligence, by an automated system, or through a combination of these methods.

12. Payments, Subscriptions, and Refunds

Purchases and subscriptions processed by Fanvue or another third-party platform are subject to that platform’s payment and refund rules.

Unless required by law or expressly stated otherwise by the platform:

Payments may be nonrefundable once content has been delivered or accessed.
Subscription pricing and available content may change.
Ending a subscription does not necessarily create a right to a refund for the current billing period.
Chargebacks or fraudulent payment disputes may result in suspension, termination, or referral to the relevant platform or processor.

We do not directly store complete payment-card details unless expressly disclosed at the point of collection.

13. Availability and Modifications

We may add, change, suspend, restrict, or discontinue any portion of the Services at any time.

We do not guarantee that:

The Services will always be available
Messages will always be delivered
Content will remain accessible indefinitely
A particular platform will continue supporting our accounts
Every technical error will be corrected
Archived or previously advertised content will remain available
The Services will be compatible with every device, account, or jurisdiction

We may modify Valentina’s appearance, voice, backstory, features, posting schedule, content style, or technical systems while retaining the general fictional character concept.

14. Security

We use reasonable administrative, organizational, and technical measures intended to protect systems and information under our control.

However, no website, bot, messaging service, hosting provider, storage system, or internet transmission can be guaranteed to be completely secure.

To the fullest extent permitted by law, we are not responsible for unauthorized access, interception, disclosure, loss, or alteration caused by circumstances beyond our reasonable control, including:

Criminal hacking
Malware
Credential theft
User-device compromise
Telegram or third-party platform breaches
Hosting-provider incidents
Internet outages
Previously unknown vulnerabilities
A user’s failure to secure an account or device

Nothing in this section excludes any responsibility that cannot lawfully be excluded.

You must notify us promptly at valelunalove@proton.me if you discover a suspected security issue involving the Services.

15. Disclaimer of Warranties

To the fullest extent permitted by law, the Services are provided “as is” and “as available.”

We disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, noninfringement, accuracy, availability, security, and uninterrupted operation.

We do not warrant that content will meet your expectations or that every message, visual detail, description, or fictional statement will be error-free or consistent.

Some jurisdictions do not permit certain warranty exclusions. In those jurisdictions, the exclusions apply only to the maximum extent legally permitted.

16. Limitation of Liability

To the fullest extent permitted by law, ValentinaXO.com and its owners, operators, contractors, licensors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of data, profits, opportunity, reputation, goodwill, or access.

To the fullest extent permitted by law, our total aggregate liability arising from or relating to the Services will not exceed the greater of:

The amount you paid directly to us during the three months preceding the event giving rise to the claim; or
USD $100.

This limitation does not apply to liability that cannot legally be limited or excluded.

Third-party payments made to Fanvue or another platform may be governed by that platform’s terms and are not necessarily payments made directly to us.

17. Your Responsibility and Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless ValentinaXO.com and its owners, operators, contractors, licensors, and service providers from claims, liabilities, damages, losses, penalties, and reasonable legal expenses arising from:

Your violation of these Terms
Your unlawful use of the Services
Your sharing or distribution of content
Access by a minor through your account or device
Your infringement of intellectual-property, privacy, publicity, or other rights
Fraud, impersonation, harassment, or deceptive activity conducted by you
Your failure to secure your account, credentials, or downloaded content
Content or information you submit through the Services

This provision applies only to the extent permitted by applicable law.

18. Copyright and Unauthorized Content Reports

To report unauthorized distribution, infringement, impersonation, or misuse of Valentina content, contact:

19. Suspension and Termination

We may restrict, suspend, or terminate your access immediately if:

You violate these Terms
We suspect unauthorized distribution
We suspect fraudulent payment activity
You create a safety, security, or legal risk
A third-party platform restricts your account
Continued service becomes technically, commercially, or legally impractical

Termination does not waive obligations that by their nature should survive, including restrictions on distribution, intellectual-property protections, disclaimers, liability limitations, and indemnification obligations.

20. Changes to These Terms

We may update these Terms to reflect changes in the Services, technology, business practices, safety requirements, third-party platforms, or applicable law.

The revised Terms will display an updated “Last Updated” date.

Where required by law, we will provide additional notice or request renewed consent.

Your continued use of the Services after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law. If you do not agree to an update, you must discontinue using the Services.

21. Disputes

Before filing a formal claim, you agree to send a written description of the dispute to valelunalove@proton.me and allow 30 days for an informal resolution, unless immediate legal relief is reasonably necessary or applicable law provides otherwise.

22. Severability

If any provision of these Terms is found invalid or unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will continue in effect.

23. No Waiver

A failure to enforce any provision of these Terms is not a waiver of that provision or any other right.

24. Assignment

You may not assign or transfer your rights under these Terms without our written consent.

We may assign these Terms in connection with a restructuring, sale, merger, transfer of assets, or change in the operation of the Services, subject to applicable law.

25. Entire Agreement

These Terms, the Privacy Policy, and any additional terms presented at the point of purchase or access constitute the entire agreement between you and ValentinaXO.com concerning the Services.
